A judge dismissed the custody petition Jason Sudeikis previously filed against Olivia Wilde in New York City family court. It is reportedly likely that the battle will now continue in California instead.

Page Six said that the “Don’t Worry Darling” director’s legal team made a bid to dismiss the “Ted Lasso” star’s case on May 18. A day prior, though, she is noted to have filed a petition determining “parental relationship,” in the Superior Court of California in Los Angeles.

The outlet consequently stated that it means the case will likely move forward in California, which is legally deemed the children’s home state.

Jason Sudeikis brought his initial case against Olivia Wilde in October 2021. As noted, he wants to live with their children in Brooklyn, New York, after wrapping filming on Season 3 of “Ted Lasso,” which he works on in the United Kingdom.

A judge, however, found that New York was not the two celebrities’ children’s home, resulting in the case’s dismissal. The court papers, which Page Six has seen, reads, “Judge Powell and this Referee agreed that New York was not the home state of the subject children; but rather California was the children’s home state.”

The document continues, “Therefore, …respondent’s motion to dismiss the custody petitions filed on October 21, 2021 is granted as this court finds that New York does not have jurisdiction to hear the custody petitions as New York is not the home state of the subject children.”

Meanwhile, Olivia Wilde reportedly “slammed” Jason Sudeikis in her court motion for serving her with the custody papers “in the most aggressive manner possible.”

The Daily Mail noted that it exclusively obtained court filings containing the actress’s arguments and thoughts about the infamous, “embarrassing” incident in April.

The “In Time” actress was served the custody papers on stage at a live event on April 26. She was giving a presentation for her film, “Don’t Worry Darling,” at CinemaCon when she was handed the envelope.

The outlet reported that Wilde referenced the infamous incident for the first time in her court motion. She is said to have slammed Sudeikis for his “outrageous legal tactics” and accused him of “clearly intending to threaten [her] and catch [her] off guard.”

The publication later quoted Olivia Wilde, reportedly claiming, “He could have served me discreetly, but instead he chose to serve me in the most aggressive manner possible.”

It continues, “Since Jason [Sudeikis] has made it clear that we will not be able to work this out for our children’s sake outside of the court system, I filed a petition for custody in Los Angeles.”
